HARTVILLE Village Council tabled a recommendation by the Board of Zoning Appeals to approve a setback variance for the planned construction of a 31-unit garage building at Lincoln Square Apartments, 300-370 Lincoln St., at its Feb. 6 regular meeting.
While the BZA approved property owner Dean Windham’s 10-foot setback variance request, from the required 40 feet to 30 feet, at its Jan. 25 meeting, several residents as well as village Solicitor Ron Starkey questioned whether the request should have even come before the BZA at this point.
"This looks like something that should have gone to the Planning Commission as well," Starkey said of the proposed project.
Resident and former councilman Jim Sullivan pointed out that the property is zoned R-3 and the area where the garage building is proposed is designated greenspace. Resident Bill Tessmer also voiced concern over whether the building would block safety service access to the street.
Mayor Cynthia Billings pointed out that the BZA was only charged with considering the setback request at the Jan. 25 meeting.
Although Starkey implied that the request would likely go before the planning commission at this point, council took no formal action at the Feb. 6 meeting, with Councilwoman Bev Green making the motion to table in order for council to have time to review the minutes of the Jan. 25 BZA meeting and further look into Windham’s proposal.
- Council also approved a resolution authorizing the sale of obsolete village-owned property by internet auction and scheduled interviews at 6 p.m. Feb. 8 for five candidates vying for former Councilman Dave Hubbell’s seat.
Hubbell resigned in December 2017 to take a job out of state and election rules required council to wait 10 days after Hubbell would have taken office in 2018 before officially advertising the open seat. At that point, Jan. 16, council members were required to select Hubbell’s replacement within 30 days, or by Feb. 15.
- Council also scheduled a special meeting Feb. 13 to select and swear in the new council member.
