During workshops when I ask the question "who knows the locations of your durable power of attorney, durable power of health or living will?," most people say I do not have them done, or  I will get them done  “when I am seriously ill.”



Due to the increasing number of people using cell phones; completing online transactions and searches, online estate planning will need to be included in online users’   important documents.  Consequently- Estate and Health Directive Plan just became more complicated!  Is it time for all of us to trust a Durable Power of Attorney with our passwords for all of  our digital accounts and actually give them  instructions on how to dismantle and delete them?    Harold H. Greene professor of Law at The George Washington University Law School comments: “Most people just don’t want to think about creating a plan for their digital assets."



One online giant, is ahead of the game. Google has create an Inactive Account Manager, which  allows  you  to name an  “individual” who can gain access to a  client’s online data once his or her accounts have been inactive for a certain period of time



Ask yourself this question:  “ How many  accounts  do I  have online with my bank, brokerage, credit cards, mortgage accounts, loans, utility bills, Pay Pal, Amazon, eBay and iTunes?



Do you realize that these online accounts will need to be closed by  your executor  when you pass or your Durable Power of Attorney when you become incapacitated?    For  a quick solution, you may want to  consider some of the online storage programs for Passwords.



Television commercials and doctors are encouraging people to get the flu shot before winter sets in to prevent a bad case of the flu. The logic behind getting the flu shot is to  build your immune system to prevent severe illness. Yet, the truth is that most Americans do not get the flu shot until they get the flu.   The  lesson:  Plan ahead, have your important legal documents completed, which include your online accounts.



Take the challenge and get your estate plan in order, the cost is minimal to prevent  having Someone else determine  what you want and how you want it to happen."
