A judge again has dismissed a lawsuit attempting to block North Canton from giving a grant to businessman Ben Suarez.
Andy Martin, a Chicago resident who is seeking the Republican Party’s presidential nomination, wanted a hearing on a lawsuit filed in June to keep Suarez Corp. Industries and its partners from getting an occupancy grant for moving a business into the Hoover District. Suarez has moved production of his EdenPURE product line to the city from China.
The original lawsuit, filed by Martin and an elderly North Canton resident, tried to block the grant by contending the ordinance was passed improperly as an emergency. Council passed a new ordinance over the course of three meetings, effectively negating the lawsuit’s claim.
Because of the change, Stark County Common Pleas Judge Charles E. Brown Jr. granted a request to dismiss the lawsuit.
On Aug. 22, Martin filed to reverse the dismissal. He argued that he didn’t have an opportunity for a hearing on the dismissal and that he wasn't properly notified of the dismissal.
Brown dismissed that filing Tuesday, saying Martin should have appealed the decision to a higher court.
Suarez Manufacturing Industries plans to begin production next week. The company expects to employ 300 people initially.
